Abstract. The article presents theoretic legal analysis of the principle of humanizing the state coercion in the sphere of legal proceedings which is revealed in activity of judicial authorities, and its regulation in international legal acts. The author investigates in detail the concept of international legal standards in the field of implementing justice and their place in the legal system of Russia. The article represents an attempt to study the topical issues of court proceedings humanization in the context of implementing the international legal standards of human rights. The special attention is paid to comparison of the principles of fair judicial proceedings and humanization of legal proceedings through ensuring the rights of the victims who suffered from criminal actions. The special attention is paid to the main directions of humanization of legal proceedings taking into account law-enforcement practice of the European Court on Human Rights in the ratio with the legal assessment of the Constitutional Court of the Russian Federation. The author studies the issues of contradictions between decisions of the European Court on Human Rights and Constitutional Court of the Russian Federation in the sphere of protecting the rights of man and citizen.
