CLASSIFICATION OF THE OBJECTS WHICH ARE IN OFFENDERS UNLAWFULLY POSSESSING AND ITS IMPORTANCE FOR THE FINDING OF THEIR VOLUNTARY GIVINGS ROLE

Abstract. The article is devoted to the problem which consists in finding the importance of the voluntary giving the objects made by the offender unlawfully possessing them. The author has developed the classification of such objects with the account of the criminal consequences of their voluntary giving. As a result, we suggest some amendments in penal legislation, in particular by its addition with the note to the Article 234 and the note to the Article 312 of the Criminal Code.
