Abstract. In this article the attention is focused at the structural specifics of the common legal proceeding. Presenting defendants apologies is as much significant as the indemnification of the inflicted harm thesis, as it is substantiated by the author. To be efficient contemporary mediative procedures should be developed in accordance with wide historical and cultural experience accumulated by different Russian ethnic groups.
