THE NOTION OF THE VOLUNTARY GIVING BY THE OFFENDER UNLAWFULLY POSSESSING THE OBJECTS

Abstract. The controversial issues concerning the notion of voluntary giving by the offender unlawfully possessing the objects are considered in the article. In particular, the author considers the problems of the voluntary giving of the objects withdrawn from the turnover during investigation acts. As a result, some amendments in the note to Article 222 and in note 1 to Article 228 of the Criminal Code are suggested.
