Abstract. The changes in criminal legislation concerning regulation of the features of the subject who evades from serving imprisonment are analyzed in this article. It pays attention to the contradiction between the
description of these features given in the Criminal Code and the description of objective aspect of crime. The author suggests the ways of overcoming inconsistencies between criminal and penal law.
