PECULIARITIES AND THE PROCEDURE OF ACKNOWLEDGEMENT OF THE PROPERTY RIGHT AS THE WAY OF DEFENSE
Abstract. In the article the estimation of a theoretical problem of ways of protection of the property right is given in a view of judiciary practice. The article is topical due to the debatable characters of situation with acknowledgement of property rights in law and legislation. During consideration of a theme some concepts is covered and analyzed, facilitating its understanding. The author substantiates that for claims of acknowledgement of property rights general prescription must be applicable, so that an individual may defend their violated rights by measures of compulsion.
