Abstract. The presented research work contains detailed study of the legal nature of the crop insurance contract. The author analyzes the current Russian legislation for the purpose of determining the place of contract in the insurance industry.
The author concludes that the contract of insurance of crops contains some signs of a property insurance contract, and business risk insurance contract is still an independent subspecies of property insurance.
The article also gives the author’s concept of crop insurance – an insurance of property interests of the insured (beneficiary) against the risks of full or partial loss (destruction) of property – crop, expressed in the reduction of the actual crop yield compared with the planned harvest in the amount determined by law and (or) agreement.
