Abstract. The intellectualization of the main production factors which determines the necessity of innovative management formation is accompanied by the intensification of scientific and technological results involvement into the economic turnover and determines the special importance of intellectual property rights. The economic relevance of corresponding legislative sector, as well as the empirical analysis of practical activity conducted by the authors predetermined this research which appeals to the process of national law-making by this civil institution. On the example of national economic entity Ltd. “GRUS” which implements hightech production, including nanomaterials, the authors study the ration of authors’ and investors’ exclusive rights in cross-border innovation cooperation. The article contains comments on amendments in civil legislation relating to the registration of intellectual activity results, as well as to special legal regime of dependent inventions, utility models and industrial designs. The authors investigate the problem of foreign patenting of domestic research and developments, suggested for export and point out the ways of its solution.
