Introduction: in modern criminal procedure doctrine, both foreign and Russian, the view of termination of a criminal case and criminal prosecution as an alternative form of resolving a criminal law conflict is becoming increasingly widespread. In this context, the term refers both to the specifics of certain aspects of the novelization of the criminal procedure legislation itself and, in a broader sense, to a kind of convergence of various procedural forms. A certain fragmentary nature of research on this relevant issue, its interdisciplinary character, novelty, and practical significance predetermine the relevance of addressing these questions. Methods: the methodological framework for the research is comprehensive, being represented by a number of methods traditionally applied in modern jurisprudence: general scientific dialectical, formal-legal, comparative law, logical-syntactic, semantic, forecasting, analysis, and synthesis. Results: within the framework of the study, the author has conducted a comprehensive examination of the institutions of termination of a criminal case and criminal prosecution in Russian criminal proceedings, assessing them as alternative forms of resolving a criminal law conflict. The work, through the prism of analyzing the legislative novelties of recent years, emphasizes the issues of humanization of criminal proceedings, the implementation of the principle of expediency within its framework, and the correlation between discretionary and imperative principles. It also analyzes the potential for updating foreign experience in legal regulation. Based on the research results, the author formulates conclusions regarding possible prospects for the further development of alternatives to criminal prosecution in the domestic criminal process, and puts forward the proposals on issues of potential improvement of the legislative regulation of the termination of a criminal case and criminal prosecution, as well as the corresponding law enforcement practice.

Key words: termination of a criminal case, termination of criminal prosecution, criminal law conflict, alternatives to criminal prosecution, criminal proceedings.
