Introduction: the paper deals with a comparative analysis of regulatory requirements for the formatting of draft laws in the Russian Federation and the Republic of Kazakhstan, taking into account the regulation in force as of 2025. The relevance of the topic is due to the fact that the quality of legal and technical formatting of draft laws directly affects the predictability of legal regulation, the possibilities of law enforcement, and trust in state institutions. The purpose of the study is to identify and systematize the main regulatory requirements for the structure, language, and details of draft laws in the two legal systems, as well as to assess the degree of institutionalization of legislative technique. The objectives include analyzing the constitutional foundations, parliamentary regulations, special methodological recommendations, and the Law of the Republic of Kazakhstan “On Legal Acts,” as well as the positions of domestic scholars on the essence and role of legislative technique. Methods: the formal legal method, the systemic approach, the comparative law method, and structural-functional analysis are applied. The factual base includes the Constitution of the Russian Federation, the Rules of Procedure of the State Duma, Decree of the Government of the Russian Federation No. 1009 of August 13, 1997, Order of the Ministry of Justice of the Russian Federation No. 222 of August 31, 2023, the Methodological Recommendations for the Legal and Technical Formatting of Draft Laws, Law of the Republic of Kazakhstan No. 480-V of April 6, 2016 “On Legal Acts” (in the current version), and by-laws. Results: it is shown that in the Russian Federation, the requirements for the formatting of draft laws rely on a combination of regulatory norms of the chambers of parliament and detailed methodological recommendations, including new methodological guidelines of the Ministry of Justice of Russia in 2023 for acts of federal executive bodies, whereas in the Republic of Kazakhstan, the key elements of legislative technique are directly codified in the law “On Legal Acts” and “Rules for the Development, Coordination, and State Registration of Regulatory Legal Acts”. A convergence of approaches regarding the structure of a draft law (name, preamble, the systemic hierarchy of structural units, uniform details, and the special requirements for amending laws) is revealed, as well as common requirements for the clarity of language and the inadmissibility of conflicts and repetitions. Scope of application of results: the conclusions can be used in the preparation of draft laws by state authorities of the Russian Federation and the Republic of Kazakhstan; in rule-making by subjects of the Russian Federation; in the legal expertise of draft laws; as well as in educational courses on legal and legislative technique. Conclusion: it is concluded that legislative technique is gradually transforming from a sphere of recommendatory doctrinal rules into a system of established regulatory requirements, ensuring the unity of the legal space and predictability of regulation.
Key words: legislative technique, draft law, legal and technical requirements, rule-making, Rules of Procedure of the State Duma, Law “On Legal Acts” of the Republic of Kazakhstan, structure of law, language of law.
