Abstract. The article examines international legal regulation of relations in the sphere of preventing the environmental transboundary harm caused by economic activity. The author studies the categories of economic activity which may cause environmental transboundary harm. Besides, the article deals with the sources of international law and the practice of international courts in the sphere of preventing the environmental transboundary harm. The results of the conducted research show that according to the international legal norms, state is liable for the breach of duty to prevent the environmental transboundary harm. However, as a rule, a person or entity carrying out the economic activity which caused environmental transboundary harm is liable for the breach.
