Introduction: this article examines the feasibility of using the institution of witnesses in Russian criminal proceedings. Methodology: a historical and legal analysis allows for the study to correlate the institution of witnesses with developments, particularly the improvement of scientific and technological means of recording investigative actions. Purpose: to substantiate the feasibility of abandoning the institution of witnesses, partly due to their lack of interest in the outcome of a criminal case and the lack of specialized knowledge necessary for critical analysis of the investigator’s actions. Conclusions: in today’s environment, there are justifiable grounds for transitioning to the use of technical recording devices as a replacement for the traditional presence of witnesses.
