Introduction: an important element of substantiating the relevance of the scientific study of Roman law as a phenomenon of legal reality is that it opens up the prospects for building new models of philosophical and legal studies of law in a real cultural and historical context. This scientific problem is important because Russian social science and legal thought for a long time have not sufficiently taken into account the achievements of world humanities and romanticism, and also been biased by ideological attitudes. The purpose of the scientific work is a philosophical and legal conceptualization of Roman law as a phenomenon of legal reality. The main scientific methods that have made it possible to realize the goal formulated in the study are: dialectical, concrete-historical, cultural-linguistic, logical-semantic, modeling, systemic-structural, comparative law, formal-legal. Results: the presented material is a comprehensive philosophical and legal study of Roman law, a cultural and anthropological approach of scientific research is proposed, suggesting its consideration not only as a legal phenomenon, but also as a socio-cultural phenomenon. The publication focuses on the fact that Roman law should be considered not only as a phenomenon of spiritual culture, but also as a picture of a specific historical culture and civilization, which leads to the variability of this historical type of law and the diversity of its socio-cultural reality. Conclusions: the scientific paper reflects the issue of the legal technology of the ancient Romans, as an organized process of creating law, which embodied the basic philosophical attitudes of the Quirites.
