Introduction. Among the global human problems in the first half of the 21st century, there is such a phenomenon as demographic transition. This concept is now the focus of attention not only among demographers but also among representatives of other sciences, including law. Today, there are many ways to solve the problem, including the use of state-legal mechanisms as well as the means of smart regulation. Purpose. To investigate the phenomenon of the demographic transition and different approaches to this term; to reveal the essence of the demographic transition as one of the big challenges based on Russian legislation; to describe the solution of demographic problems by legal means and the means of smart regulation. Methods. The methodological framework for the research was made up of the general scientific methods of analysis and synthesis, as well as the specific scientific methods of formal legal and comparative law. Results. The demographic transition was developed as a theory in the middle of the 20th century to describe the existing processes of changing the size and composition of the population and its reproductive stereotypes. At the turn of the 20th and 21st centuries, the concept underwent a rethink. In Russian legislation, the demographic transition is designated as a big challenge. Legal remedies and smart regulation tools correspond to this challenge due to the special sensitivity of the sphere of population reproduction. Conclusions. The demographic transition is a qualitative leap in such an area of social and economic reality as population reproduction or decline. The state measures of influence in this area of social relations are fixed in the normative legal acts. The non-legal methods of influence (smart regulation) are incentive-based and spread through social advertising.
