Abstract. The article gives a short specification of the basic approaches to the definition of a place of the legal procedure in the course of realization of the rights and liberties of man and the citizen. The author shows the importance of the legal procedure for complete and effective implementation of rights and liberties. The suspense of problems in the adequate use of legal procedures leads to negative displays in the activities of state structures aimed at ensuring the rights and liberties man and the citizen is shown.
