Abstract. The article considers the genesis of the legal development of institute of intellectual property in Russia. The author states a position about the necessity of updating of the current legislation in Russia in the sphere of intellectual property. The special attention, according to the author should be given to the intellectual property development in the sphere of activity at innovative enterprises which are being created at present.
