Abstract. The authors of the article focus on general and detailed analysis of modern researches in the field of the theory of the legal practice and the customary law in civil law, the theory of law, the history of the theory of law and other juridical studies viewed from constructive and fruitful criticism. In addition, the authors distinguish and analyze the basic tendencies and perspectives in the development of the legal practice and the customary law connected with the notion of the mentioned sources of law of the Russian Federation, the authors also substantiate the research conclusions about inadmissibility and inapplicability in practice of the majority among the above mentioned theoretical investigations.
