Abstract. The estimation of a theoretical problem of the ways of protection of the property right is given in the article. The article by Olga Seregina is topical due to the debatable characters of the situation with acknowledgement of property rights in law and legislation. In the course of consideration of an issue some concepts are covered and analyzed, facilitating its understanding. The author substantiates that the claims of acknowledgement of property rights play an independent role.
