Abstract. The article deals with the analysis of R. Carre de Malberg’ ideas, that stipulates the formation of the concept of rule of law in France. The author considers the main characteristics of the rule of law, notes the debatable aspects of its essence, shows the influence of the investigated views in historical perspective.
