Abstract. The article is about legislative registration of institute of reorganization that arises at a certain stage of capitalist relation development when the concentration of capitals and manufacture was confirmed as a general tendency and the aspiration to a monopolistic position in the market was issued. The author points out that of all existing means of economic society reorganization (merge, joining, division, allocation and transformation) it was the merge that was primarily formulated, which was later followed by the reorganization as a form of joining.
