NORMATIVISM AND LEGAL POSITIVISM IN THE “INTERNAL STATUTORY ACTS” RESEARCHING: THE DEFECTS OF THE THEORIES

Abstarct. The article shows the normativism and legal positivism ideas influence upon the doctrine of internal statutory acts in Russian jurisprudence. Defectiveness of the interior rule-making obligatory state authorizing theory in the modern political, legal and economic conditions is substantiated. The author concludes that there is a need to use the achievements of the sociological school of law in the analyzing phenomenon reassessment process.
