Abstract. To improve activity of courts in the field of ecological law-enforcement practice taking into account the latest innovations, the changes and additions to the decrees by the plenum of supreme court of the Russian Federation on the issues of criminal liability in the sphere of nature management, fishing and water resources preservation seems to be timely and necessary. The illustration of negative trends of legislation and law provisions explanation must be one of the most important directions of supreme court activity.
The author studies the notion of precedent and judicial explanation as well as the character of their application in the judicial practice. To form the unitary judicial practice it is necessary to supplement the decrees with provisions regulating and specifying the content of the common features of ecological crimes.
