Abstract. The article analyzes the mitigating and aggravating circumstances and their role in the cause of punishment according to Russkaya Pravda (in the brief and in the detailed version). The authors analyze such mitigating and aggravating circumstances as “intoxication”, “incomplete crime”, “participation in a crime”, “social status of the victim”, “multiple offenses”. The old Russian source that we investigated incorporates only a small part of rules which were applied in practice, so it cannot provide a complete and thorough information about old Russian law.
