Abstract. The article under consideration focuses on the use of the basic principle of civil law, i.e. the principle of freedom of contract in intellectual property law. The author dwells on the complexities of applying the principle of law that arise from the fact that in the field of intellectual right there occur specific principles such as the principle of protection of public interests, widely used in patent law, which has a number of differences and contradictions to the principle of freedom of contract.
