Abstract. The paper attempts to critically rethink the traditional division of legal reasoning to the case in the light of the doctrinal and methodological discourse of contemporary philosophy of science, and proposes an alternative classification of legal thinking.


Key words: doctrinal and legal precedent thinking, legal system, hierarchical levels of legal reality, thinking about the rule (legalism), thinking about the decision (decisionism), thinking about the procedure and form.
