Abstract. On the basis of analyzing the regulations of the Constitutional Court ruling
adopted on July, 2 2013 № 16-P the author concludes that these regulations implementation in
the criminal procedure leads to the system crisis and possible destroying of competitive
construction of litigation proceeding.


Key words: competiveness of parties, recommitment of prosecutor’s criminal case,
additional investigation, prosecutor’s dismissal of charge, proscription of reformatio in pejus,
freedom of appeal.
