Abstract. The article is devoted to the problem of modernization of the approaches to legal implementation influence on social relations. The historical and contemporary juridical materials are given where the logic of comprehensive approach to the system of building of legal regulation is worked out. The significance of the transition from the policy of bans and restrictions to the consolidation of the role of incentive mechanisms in law and judicial system in modern conditions is justified.
