Abstract. In the article a hypothesis is proposed and argued in relation to the strategy of cognition of law through measuring of violations in functioning of law, otherwise speaking, through the problems of dysfunction in a legal sphere. The author introduces the concept of “legal dysfunction”, the definition of which is offered, the varieties of legal dysfunction are classified, the reasons and ways of overcoming it are outlined, in form of raising the problem the necessity of comparative research of legal dysfunction is grounded for modern law orders.
