Abstract. The article defines the structure of cassation court session on the basis of the analysis of the norms specified in Chapter 47.1 of the Criminal Procedure Code of The Russian Federation. The author identifies legislation problems of regulating the activity of courts and other participants of cassation proceedings at court sessions and suggests to supplement a number of articles of the criminal procedure law with regulations, specifying the actions of the mentioned entities. Analyzing the article 401.13 of Criminal Procedure Code of the Russian Federation the author comes to the conclusion that the new provision has been introduced into the regime of making the cassational decision – the rule of favorable opinion support for a convicted person, an acquitted person and a person against whom the criminal case was terminated.
