Abstract. The article deals with the main features of the indictment defining its place and value in system of criminal proceedings in Russia and Tajikistan. For this purpose the structure of the indictment and its parts were analyzed. At the same time, neither the Criminal Procedure Code of the Russian Federation, nor the Criminal Procedure Code of RT do not provide its legislative definition. In this regard, among the basic concepts of the Criminal Procedure Code of the Russian Federation and the Criminal Procedure Code of RT it is expedient to fix the indictment, understanding it as the final document of pretrial investigation which contains conclusions of the investigator about the commission by an accused person of a certain criminal act on the basis of comprehensive,
full and objective investigation of facts of the case. Carried out comparative and legal research of the indictment according with the legislation of Russia and Tajikistan creates favorable conditions for improvement of the specified codes, mutually enriching and supplementing each other.
