Abstract. In this article, the author draws attention to the features and characteristics of the customary law regulating custody of the Don Cossacks during the second half of the XIX century. The author concludes that the complex and contradictory nature of the Cossack rulemaking and features of customary law regulating care depended on the peculiarities of the mechanism of action of customary law and the decisive role of the Don Cossack communities in this process. These issues have not yet been the subject of scientific research in historical-legal, historical and ethnological sciences.
